The service offered by Naria through its website allows the food sector (producers, manufacturers, distributors, retailers, Horeca) to advertise their donations. In turn, the social sector (Food Banks, foundations, social entities...) can accept, manage, validate and distribute donations through the same website provided by Naria.

Terms applicable to Food Donors

The DONOR has the following responsibilities:
1. to ensure that the details of his/her company added to the application are truthful.
2. To provide the necessary documentation for the registration of the company in the Platform, and that relating to the detail and cost of each donation.
3. Guarantee that the information uploaded to the application is a true reflection of the operation.
4. Guarantee the personal and non-transferable use of the assigned account.
5. Maintain the company's contact details up to date.
6. Inform Naria of any modification or change in the Legal Representation of the company.
7. To guarantee that the food products published in the application are in an optimum state for human consumption, as established by law.
8. Prepare the clearly identified donation at the designated collection point within the times indicated on the platform.
9. Comply with all obligations established in current legislation.

Terms applicable to the Social Entities that receive donated food
The BENEFICIARY has the following responsibilities:

1. That the details of the social entity added to the application are truthful.
2. Provide the necessary documentation for the registration of the social entity in the Platform.
3. Guarantee that the information uploaded to the application is a true reflection of the operation.
4. Guarantee the personal and non-transferable use of the assigned account.
5. To keep the contact details of the social entity up to date.
6. To inform Naria of any modification or change in the legal representation of the social entity.
7. To ensure that donations from donors registered in the application are always made through the application itself.
8. Collect the donation following the donor's indications as to the location of the collection point and the timetable indicated for accessing the donor's facilities.
9. To be in charge of the collection logistics and carry out the tasks required for the management and handling of the food received as a donation from the moment it is awarded through the application.
10. To be responsible for the donated goods after their collection from the donor company's facilities.
11. Verify the characteristics of the donation in terms of quantity, weight and type of product, and verify the donation through the application, on the basis of which the approval of the donation certification will be executed.
12. Comply with all obligations established in the legislation in force.

In those cases in which the USER fails to comply with its obligations, Naria may suspend or cancel access to the APPLICATION partially or totally, prior notice by e-mail to the USER indicating the non-compliance, and giving the USER a reasonable period of time to remedy it.

General Terms

Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall NARIA be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or in connection with the use of or inability to use the service.
NARIA accepts no liability, either directly or indirectly, for the misuse of the web site or its contents by the User, and the User assumes sole responsibility for any consequences, damages or actions that may arise from accessing or using the web site or its contents, as well as for reproducing or communicating them.
NARIA is not responsible for any content, files, information, advertisements, opinions, concepts and images that are issued, published or distributed directly or indirectly through any linked website accessed through the website by means of links, or any of the services that are linked or related to this linked website.
